Jaramillo wins back pay from county in judge’s ruling

Former Assistant Sheriff George Jaramillo is entitled to three years of back pay and benefits from the county on his claim that he was unlawfully terminated by former Sheriff Mike Carona, a judge said in a tentative decision released today.

The ruling potentially means the county must pay Jaramillo about $485,000, plus attorneys’ fees.

Judge Andrew P. Banks of Orange County Superior Court wrote that Carona violated the state’s Public Safety Officer Procedural Bill of Rights when he fired Jaramillo in 2004. Carona refused to give Jaramillo an opportunity for an administrative hearing and failed to give notice of his decision to impose discipline, Banks wrote.

Banks awarded back pay and benefits to Jaramillo from the date he was fired, March 17, 2004, through Jan. 28, 2007, when he pleaded no contest to two felonies.

In a non-jury trial before Banks, which was held in April and May, Jaramillo’s lawyers argued he was owed about $720,000.

However, the judge wrote that the county can deduct $234,294 from the amount it owes Jaramillo, finding that Jaramillo earned that much during the three-year period.

The county had argued that Jaramillo had signed away his rights to a hearing and notice of discipline.  “They are wrong on both counts,” Banks wrote.

Banks also wrote that the county must stop trying to get senior Sheriff’s Department officials to waive their rights under the Public Safety Officer Procedural Bill of Rights. Any such waivers currently in force are unlawful, Banks wrote.

Jaramillo isn’t entitled to non-economic damages, but he can collect reasonable attorneys’ fees, Banks wrote.

Joel Baruch, an attorney representing Jaramillo, said the tentative status of the ruling means both sides will have an opportunity to ask the judge to clarify or reconsider aspects of it.

Baruch said he will ask the judge to hold a hearing to determine exactly how much the county must pay Jaramillo. He said Jaramillo’s annual salary was $139,000, with benefits likely worth another 35 percent of that.

David Lawrence, an attorney who represents the county in the case, said he couldn’t immediately comment on the tentative ruling.

Jaramillo, once considered a likely successor to Carona, was appointed assistant sheriff by Carona in January 1999. After Carona fired him in March 2004, Jaramillo pleaded no contest in 2007 to state charges of public corruption. He was sentenced to a year in jail and ordered to pay $10,000 restitution to the county.

Carona was convicted of witness tampering in January of this year and was sentenced to 66 months in federal prison, where he is scheduled to report on July 24. During his trial, witnesses testified about extra-marital sexual affairs Carona conducted while he was sheriff.

In his ruling, Banks wrote that he found credible Jaramillo’s claim that he was fired partly because he “notified former Sheriff Carona that Carona’s use of County property, including automobiles and helicopters, for sexual liasons, was improper.”

      you most likely are WRONG… probably not a union member… Most management in public service have different bargaining groups. Most likely not a member of the actual non-administration part of the sherriff’s group…

      Show me the facts that he is a card carrying union member, and I shall retract my statement. Up until this point I have no reason to believe you are correct, and your statements are only based on your hatred for organized labor, and public service employees.

      Think again innocent bystander number 1 he is not a union member, he was admin, not allow to join. Number 2 you OC residents are the ones who put corona and good old george in power. AOCDS backed Paul from Santa Ana PD but no one listened. Corona then won his second term with no one running against him. Corona one his third term when AOCDS backed Lt Bill Hunt. So do not blame anyone but yourselfs……..Next time listen when the Deputies tell you someone is a criminal.

      Perfect example is this case with Jaramilo. And another issue with homeowners who bought homes that they can’t afford. Now our wonderful gov’t is using YOUR tax dollars to bail them out!!!

      Sorry, i know this homeowner thing is not related to this article, but i just gotta point it out.

    How could the Judge award him back pay for the 12 months between 1/27/07 - 1/28/08? On 1/27/07 he was sentenced to 365 days in jail for felony perjury (violation date 4/22/04) and felony misappropriation of public funds (violation date 10/10/02). Exactly how could he be entitled to pay and benefits while in jail?

    Of course, this was after the DA dismissed 8 felony accounts dating back to 2000 for bribery, misappropriation of funds, and conspiracy to commit an act injurious to the public as part of the plea agreement in conjuntion with the ‘02 and ‘04 violations of law.

    Only a public employee union, and a Judge with little or no sense could be involved in such an unjudiious outcome. Sickening ! I hope kharma arrives at Jaramillo’s doorstep sooner rather than later.

    SoCoDave, I agree however Mike Carona and the OCSD violated his GC 3300 rights also know as AB 301 or the Peace Officer Bill of Rights and most likely his Skelly rights. There is a process and the dirt bag had rights. If it would have been done properly, Jaramillo wouldn’t have got squat. Thats why you see dirty cops get their jobs back all the time. There is a process and it has to be followed unless the person is an At Will employee.

      So what’s so hard about following the rules? All of us have to do it. What’s to say some dirtbags working for the county turned their heads the other way INSTEAD OF FOLLOWING THE RULES, so their friend Jorge could hit the lotto? Why aren’t the ones who were SUPPOSED TO FOLLOW THE RULES being punished or losing their jobs. Any idiot can remember the rules as long as they have a checklist. Aren’t checklists allowed at OCSD or in the county legal offices? What are we paying these idiots for? Why don’t they make the ones WHO FAILED TO FOLLOW THE RULES pay the settlement? Why do I have to pay for it? I wasn’t even there! Corrupted slimeballs!

        Obviously OCSD did not follow a lot of rules and that is why they are in so much trouble. What occurred at OCSD has given law enforcement a “black eye” per se. Most law enforcement agencies have good internal affairs offices and follow the guidelines of Gov’t Code 3300. I’m paying for it too and I was not there either and I’m in public safety.

        Corona established a culture of bending (or breaking) the rules, fostering cronyism and taking all available shortcuts for the sake of expediency . This is the end result of his mismanagement of the department. And when Hutchens comes along and tries to make the changes she thinks are needed to address the situation, the BOS and everyone else with a personal agenda or opinion is there to second-guess every decision and policy change without giving her a reasonable period of time to turn things around. Expecting her to turn things around 100% in less than a year or avoid ANY mistakes is unrealistic. Instead of criticizing every move she makes, step back, give her free rein and then let the voters decide come election day.

    How many people complaining about Carona and Jaramillo voted for Carona or didn’t vote at all? That Carona had questionable ethics was no big shock. What is a shock is that the Republican Party continued to support him.

    Wasn’t the BOS told this would come back to bite them if Jaramillo were fired without a hearing? If he had had the hearing, he would have tossed and not owed the backpay.

    Makes you almost think Carona did Jaramillo a favor.

    It’s all about statutory law guys not the “unions”. The screw up lies with Carona and County officials. I’am sure some of the Republican elites pressured Carona to can Jarmillo and not follow the law. We can also thank the likes of Moorlach and other Supes for endorsing Carona knowing all they did about him thanks to the LA Times and Scott Moxley. Now Moorlach is probably signing off on the settlement. Guess what? Galisky’s big payday is coming too. Oh the irony.

    Jaramillo was NOT a union member. The award was based on the fact that he was a peace officer at the time that he was termiinated. The law entitling him to a hearing was clear at the time that he was fired. Had the Sheriff’s Department just followed the law his termination for misconduct would have been upheld at the time and he would have just gone to jail.
    The anti-union anger in comments about law enforcement is sickening. In fact, the anti-union comments in this paper are sickening. I often wonder if those making the comments would refuse to join a union if they were working in a difficult job for low pay and no benefits. I doubt it. Perhaps their anger isn’t directed at the idea of a union, but at the success of unions in representing their members.

      Not sure if you’re comment was directed at me. I didn’t say Jaramillo was a union member. However, The California Organization of Police and Sheriffs was a principle author and a co-sponsor of AB 301, and the Los Angeles Police Protective League was the primary sponsor - although only legislators can actually introduce a bill to become law. Hence my publlc employee union comment. Do you think a legislator would have come up with such an idea on their own?

      As to your “wonder if those making the comments would refuse to join a union if they were working in a difficult job for low pay and no benefits” comment - I did so when I was younger, and ultimately became the Union Shop Steward for 600 employees of the Seafarer’s International Union. Ultimately, I sued that union for threatening physical force if I didn’t contribute to their Political Action Committee which - surprise, surprise - supported leftist policies. The fact the contribution by law was voluntary didn’t seem to concern them. The NLRB awarded me a handsome settlement.

      When I figured out the the real goal and purpose of unions was to control politicians through contributions from the dues and pac contributions they extracted from members, I lost faith in them. Does anyone think that a Democrat can be elected in this state without public union support ? Go to the Secretary of State’s campaign contributions listings and see for yourself.

      Although of great value at one point in history, unions - particularly public employee unions - are facilitating a move towards statism (read socialism.) If you don’t think so, you’re brain dead or you’re part of the movement.

        So, if someone doesn’t agree with you, they are brain dead or part of the movement. That’s a very mature response. I think we all need to take a look at where politicians get their money from and do some math. Corporate giving through PACs and other means dwarfs the amount of money that unions spend. What you are failing to consider is that politicians from both sides of the aisle receive support from both corporate entities and unions. Take a look at the board of supes. You won’t find a finer bunch of republicans anywhere and their campaigns are riddled with special interest AND union money. It was a GOP board that approved the generous pensions enjoeyed by deputies. Unions just do what everyone else does and all politicians have their hands out because it costs money to win races. The socialism/statism fear is just so much “boogeyman” baloney. There are lots of socialist countries that are democratic and while I don’t advocate a European system for the U.S., I think you would be hard pressed to define England, France, Spain etc. as “statist.”

          When government spending, as a percentage of GDP, reaches over 50%, I would suggest that a reasonably mature person would conclude that government has taken on a statist nature. The higher the percentage, the more the government versus the private sector controls the economy.

          Those not aware of this trend in the US would be brain dead in the sense that they aren’t bright enough to notice or care. Others, particularly those who benefit from government spending, i.e. teachers, other government employees, and those who rely on government ( taxpayers) funds for their survival, want more government spending because it directly benefits them - regardless of the effect on those that pay for government services and welfare. These individuals, along with others who prefer collectivism as a form of government, can be said to be “part of the movement.”

          Using your examples, here are the numbers for government spending as percentage of GDP: France - 61%, England - 50%, Spain - 47%. The projection for the US in 2009 is approximately 45%. Should all of Obama’s social engineering plans come to fruition, within just a few years, the US could rival or surpass France.

          Democracy should be more than 2 wolves and a sheep voting for candidates. The more people rely on government spending for their economic existence, the more votes will acrue to candidates that advocate keeping the trough full.

          I agree that politicians receive nearly all their funds from unions and special interest groups looking for political payback. The OCSD benefits agreed to by the former BOS shows how insidious union contributions to political whores has become.

          Certainly business-interest political contributions will be more likely to favor Republicans, but almost always you’ll find a more even split in contributions to both parties with business than you will with labor. I believe your statements in this regard are based on little more than a guess - and echoing the liberal mantra - rather than research and fact.

    The Government, or a qui tam plaintiff, should pursue a civil claim against Jaramillo, for false claims while he was in office under Government Code Section 12650. The guy was and is a crook. We are going broke as a county and State and some ding dong judge gives a half a million because he was fired for being a thief . . . what is wrong with this picture. As taxpayers, let’s get back all the money spent on Jaramillo’s helicopter rides, sexual trysts, and illegal campaign crap with Corona. Maybe the Federal sentence (time plus money) can recoup some of the one-half million bones we are stuck with as a result of banks’ gift to George.

    I think police officers have far too many rights when it comes to employment, far more than folks in the regular/private sector — even excluding union perks.

    How many times do we hear about some cop who is finally sued and in court he comes he/she has a history of problems? The public’s not allowed to know.

    Police officers are public employees, entrusted with a great deal of responsibility. When they are found to have misbehaved, the public should have the right to know.

    That would eliminate a lot of the croynism and “old boys network” issues that law enforcement seems to engender.

    There would be fewer cases of bad cops if they knew their misdeeds — I’m talking about founded ones, not just unfounded complaints — couldn’t be hidden in their files thanks to the Peace Officers Bill of Rights.

    It’s hard to believe a judge found “credible” Jaramillo’s claim he warned Carona that his use of Sheriff’s resources was a problem. Was he giggling when he said it? I thought the evidence was that Jaramillo facilitated Carona’s affairs - wasn’t one of the affairs with Jaramillio’s own sister? And Jaramillo had his own problems with misuse of Sheriff’s resources (the helicopter to pick up his wife’s purse being a primary example.) These guys were engaged in a conspiracy and it’s unfortunate that this did not matter under the law that the judge had to apply.

    Know Nothing at All- You’re wrong. Just because the judge decided to apply something to JaraSCUMmillo that is only offered to law enforcement personnel does not make it a ‘right’. Read the Memorandum of Understanding. Doesn’t apply to Assistant or Undersheriff.

    At the same time the average deputy is looking at pay cuts the board of supervisors continues with their lawsuit to take away our negotiated retirement. Deputies are possibly going to be laid off and more retired people are coming from LA and double dipping. Retirment cannot come fast enough. I used to enjoy being a deputy and helping the public now it is just a job.

    unions are only as good or bad as their leadership and membership.

    what is sickening is California (one of the largest economies in the world) and many county, state and municipalities going broke from greedy politicians offering more to union leaders and their membership than they know (or should know) can ever be paid in exchange for votes at the expense of citizens.

    greedy, ignorant unions are sickening. honorable fair minded unions are great. it really doesn’t matter, in the end the greedy union leaders and their ignorant membership will get what they deserve. just ask a retired United Airlines pilot about his pension….

I believe that we need to demand IQ tests, credit and criminal background checks as well as thorough vetting of all proclamations on college transcripts and resume’s before allowing anyone to be placed on a ballot to serve my interests. In addition all lawmakers in California should have to show well they can do on the California mandated star tests and the exit exam. I believe most of them are hardly qualified to lead anyone!

    Yeah, Skippy shoulda known better before lowering the hammer on this corrupt fool, but anyone who knows how the County system works is fully aware that County Human Resources & County Counsel were no doubt in the loop and “signed off” on the dismissal.     Interesting. Me, I made a small mistake on one form I submitted to unemployment and they are going to terminate my benefits. I’ve talked to others who are also having trouble getting their unemployment. But we are going to foot the bill for this criminal? The judge who made the ruling makes probably 200K to 300K a year and never has to worry about getting laid off, so it’s no skin off his back. There’s a reason this country is going under. Our government no longer represents us. It’s all a grotesque farce. We no longer manufacture or make anything important, we just push papers and lawsuits and electronic fund transfers around. And the most corrupt make the most money, out of taxpayer pockets. Adios, America!

    Jaramillo is the biggest sleeze bag in the world but he does know how to play the system.He owes the county money for being such a incompetent Asst Sheriff and using a counyt vehicle to get oral gratification from a female county employee.Now Galisky sees her payday coming even though its BS and she was a Lousy ASST sheriff too. Besides she didn’t get fired she resigned becasue she knew if she didn’t she would be indicted by the grand jury for lying referance the Chamberlain.

    Irrenlevant, Jaramillo was fired from Garden Grove and through the use of a threat of a lawsuit for discrimination was allowed to get promoted and resigned immediately. He was tied up in some embezzlement issues there. For Carona to even consider him, shows the character of Carona. They got what they all deserved. OCSD was a joke during that time, the next lawsuti I want to hear about is Bill Hunt’s political retaliation one against OCSD and Carona. He will get millions..good for hunt..How funny it will be when Carona has to come back for civil trial and possibly be housed in OC jail..good for him..

    Jaramillo will continue to pimp out his wife and sister in law becasue he is such a sleeze bag.Hope the coun ty goes after the money for payback for him being a lousy ASST Sheriff.Hope this won’t make it hard for Sheriff Hutchens to get rid of that assucking sellout Jack ASs Anderson. Hi too is a Lousy ASST Sheriff and has NO backing from rank&file in the department. Sheriff was smart to put him in a position where he has very little authority and command status.

    Mike - Mr. Jaramillo was not fired from GGPD. He came out 5 or 6 on an Lt. promotional exam and threatened to sue the department for racial discrimination (available for viewing in OCR past issue) because there was no chance he was going to get promoted. In fact, there was only one Lt. position available and the chief gave it to the person who placed last on the list. An agreement was reached between Mr. Jaramillo and the city in which he would be promoted to Lt., but then put on what I believed to be Admin. Leave and then resign either right before one year and shortly after. The reasoning by Mgt. was that Mr. Jaramillo was like a cancer and it was best to just cut him out and get rid of him. But he was never fired, unfortunately.

    Well, I should not be surprised. Once upon a time, I used to believe that government — loca, state and / or federal — used to be for the common good. Now, this has to happen. Our country has enough problems as there are. Corruption and malfeasance are now the norm in our society.

    I really feel sorry for society as I am starting to lose confidence in its well being.

    There is something I will never understand about our state, county, city, federal govs, maybe someone can explain to me. Why is it that an individual can sue and take the taxpayers money, when none of us had anything to do with it? For example, when a cop illegally beats someone, why do I as a taxpayer have to pay? I think it must be some kind of conspiracy between the govt and filthy lawyers. They just play with our money with no repricussions. No one takes responsility, just file a lawsuit, its all monopoly money anyways, not coming out of my pocket, the taxpayers won’t even feel it. Someday, maybe this day has come, there will be no more money, then what?

    Another thought, usually when someone sues a business, it goes under and maybe the owner has to take personal responsibility. He can’t go to his customers and say ” well I just got sued, i have to raise prices on everything” Nope, he just goes out of businees and the plaintiff ends up getting nothing. On the other hand the govt, can never go out of business, they will just raise taxes and have less services to the citizens if sued. Maybe the insurance company will cover it but still, its a big waste.
